[提要]微信“代购”，因其便捷性受到很多年轻人青睐。最近，临沂兰山区的彭先生就通过微信朋友圈买了一件羽绒服，付款一个多月了，羽绒服还没有到，钱也不退了。

　　3月16日讯&随着微信的使用越来越普及，微信&朋友圈&逐渐成了&生意场&，只要打开手机微信，总有几个认识或者不认识的朋友在&朋友圈&里发布各类商品代购的信息。微信&代购&，因其便捷性受到很多年轻人青睐。最近，临沂兰山区的彭先生就通过微信朋友圈买了一件羽绒服，付款一个多月了，羽绒服还没有到，钱也不退了。

　　临沂市兰山区彭先生说：&朋友的朋友吧，朋友圈里找的这么一个人。看他是卖服装的，年前吧，就想着弄点便宜点的服装，打算过年嘛。&
　　彭先生告诉记者，通过朋友圈里的图片，他看到这些衣服都是大品牌，并且价格比商场里的要便宜很多，于是他挑选了一下，打算买件羽绒服。彭先生说：&有黑色的、藏青色的，刚开始说350元，后来说350元不行，得400块钱。&经过一番讨价还价，彭先生最终以400元购买了这件羽绒服，随后，他通过手机转账付了款。
　　彭先生说：&年前他说就可以发到货，但是这都过完年这么长时间了。货也没见、款也没退。&2月7日付的钱，到现在过去一个多月了，羽绒服还是没有到手。彭先生越想越着急。随后，他拨打了这家微商的电话。
　　对方表示，没发货是因为当时这个型号的羽绒服卖完了。到现在还不退款，是因为彭先生在朋友圈里说他是&骗子&。
　　微商称：&人家没人说我，你在这里说我是骗子，在那里说我是骗子，人家都过来找我。&
　　彭先生说：&你如果换过来想的话，你把钱给我，然后一个多月不退给你钱，你会怎么想？&
　　微商称：&既然你已经说了，我干嘛还发货呢，我干嘛还退款呢？&
　　通过微信上显示的信息，记者发现，这家微商并不是本地的，而是浙江杭州的。那么，对于彭先生遇到的问题，应该如何解决呢？随后，记者与他一起来到了临沂市工商局12315申诉举报指挥中心。
　　临沂市工商局12315申诉举报指挥中心工作人员说：&我们是分辖区受理，我们只能监管到临沂的商家，如果是在临沂购买的商品，或者说是商家是临沂的帮你调解一下。但是这个情况是有前提的，你给我们提供交易的记录和商家的具体地址。&
　　朋友圈变生意圈 微信购物难维权
　　据工作人员介绍，由于微商没有市场经营主体，只是代买、代销的关系，目前法律法规处于空白，监管和维权都有一定的难度。
　　临沂市工商局12315工作人员：&商家是杭州，你想投诉，拨打12315投诉。你也需要向他提供地址。如果不提供，他也没有办法帮你处理。&
　　工作人员提醒，消费者在朋友圈购买商品时，需要加强对商家和商品的了解，谨慎购买。
　　临沂市工商局12315工作人员说：&因为在微商上面的一些交易，他们一般都没有正规的营业执照，也不会在工商局注册。所以像这种尽量不要相信一些，不要在微信上购物。&
　　虽然微信购物比商场里的要便宜，但是一定慎重，最好选择有第三方支付平台的商家。不然的话，遇到问题，维权也是件麻烦事。
